National Action Financial Services Penalized

New York Attorney General Andrew Cuomo successfully settled with a debt collector accused of abusing debtors. National Action Financial Services (NAFS) of Williamsville, NY has agreed to pay $85,000 in penalties and costs.

NAFS also has agreed to reform its business practices so that it becomes compliant. This means it must abide by provisions of the Fair Debt Collection Practices Act.

NAFS was the subject of nearly 90 complaints, many from New York residents. Their alleged violations include:

  • skip tracing violations
  • falsely claiming to be calling from an attorney’s office
  • harassing employers of debtors
  • numerous state and federal collections violations

NAFS has cooperated with the investigation. They must submit a report to the Attorney General by March 11, 2008 to document their compliance.

    NAFS has a women named Ms Drayton that claims they are a subsidiary of JP Morgan Chase . They also claim they are not a collection agency

    A representative who calls herself Dominique McEntyre repeatedly calls me at my job after I have told her that I cannot take such calls at my place of employment and to remove that number from their list. She says she has the right to contact me at work once per day and will keep calling until I pay them $500. On July 2, she yelled at me and demanded that I give her my checking account information over the phone. I told her that she was crazy. I thought creditors could not call you at work after you told them you could not have those calls there.

    The actions that you are describing could potentially be violations of the Fair Debt Collection Practices Act. If so, the debt collector could be liable for monetary damages.

    I recommend that you contact your state’s Attorney General office to file formal complaints on any activities that you believe violate your rights.

    these [expletive] harass me as well. It’s funny how they think they hve all this power and recite pre-rehearsed nonsense and try to scare you into paying. Most people fall for this. It’s a shame.

    This company is a scam, they have multiple violation of the debt collecting act have been sued and currently have a BBB rating of D that should be a F since they resolved less than half the complaints they have against them!

    these people are going after my brother who is on SSI and metally disabled on a debt that is “over” 10 years old. They are worthless. I will be contacting our attorney’s general to report them.
