(Sarah from Georgia) Can A home be moved from property before foreclourse?
Dear Sarah:
It sounds like you have a modular home on your land. Unfortunately, if the home is part of the mortgage loan, then it is included in the foreclosure. Moving the home without lender approval would be a mistake.
It is possible that the lender may not want the home, and may indeed prefer that the mobile home be moved from the property at your expense. However, you must get lender approval clearly authorizing you to remove property from the premises. Their approval should list any and all items that you are allowed to remove.
You will need to communicate with the lender and get the details of any agreement in writing. If you need legal assistance but cannot afford to hire an attorney, then you may want to check with Legal Aid to determine if you qualify for free legal advice.
I recommend checking with your lender first to inquire about the possibility of keeping the home. Of course, you will also want to determine the costs involved with keeping and moving the home. It is possible that you may be better off moving into a rental unit for a while.
